What is Hit and Run?

Hit and Run, otherwise known as failing to stop or report an accident is a criminal offence that can come with some hefty fines and penalties. As a driver, it is important to remember that if you were involved in an accident, whether severe or not, it is important to stop at the scene and exchange details. If you have been charged with hit and run, we highly advise that you contact one of our motoring experts, at Solicitors On Your Side Scotland.

Examples of failing to stop:

  • Failing to stop at the scene of the accident
  • Failing to exchange details with the other driver
  • Failing to report the incident to the police within 24 hours

Reasons for failing to stop or report:

  • It was too dangerous to stop
  • You were not aware that the accident occurred
  • You stopped but the other driver failed to

We understand that each motoring case is different, and endorsing points and penalties may not always be the fair course of action, especially if you may be risking your licence. Our solicitors will ensure to get to know you in your case to the highest extent, ensuring that you come out with the best possible outcome. Save your licence now, and contact Solicitors On Your Side Scotland for a free initial consultation.

The Road Traffic Act

According to Section 170 of the Road Traffic act of 1988, it is an offence to fail to stop and report and exchange details.

If you are unable to stop or identify the owner of the vehicle or property, you must report this to the police station within 24 hours. In many cases, drivers are charged with this offence when they fail to stop and report minor bumps or scrapes, during which they may not be aware of what has occurred. Depending on the severity of the hit and run case, the charges can vary and if you have been charged with this offence, we highly advise you to contact our knowledgeable solicitors now.

Penalties for hit and run

The most severe consequence for failing to stop is a prison sentence of up to 6 months, which is when the offence involves severely injuring someone during an accident. This offence carries 5-10 penalty points, depending on the severity of the offence and an unlimited fine. If you have been charged with failing to stop or failing to report, we highly advise that you contact one of our experienced motoring solicitors now, and guarantee the best possible outcome.
