Type of claim

In Scotland from 1994 to 2000, the Scottish Trauma Audit Group collated evidence and information regarding the comparison of injuries experienced between drivers and front-seat passengers. Many of us have probably read studies during which a passenger and driver were involved in an accident, and many times the drivers survived the accident and the passenger didn’t. Well, there is a science to prove that this may be true; out of 4189 drivers and 954 front seat passengers, the mortality was higher in the front seat passengers.

This research also examined the parts of the bodies injured which showed that seven out of the eight body regions examined showed a higher rate of injury in front seat passengers. There were more injuries in:

  • The cervical spine
  • The chest
  • The lumbar spine
  • The front-seat passengers

This study concluded that front-seat passengers have an increased risk of injury relative to drivers in road traffic accidents. This study also contradicted crash test data, which predicted that drivers are less protected than the front seat passengers.

What are the main causes of road traffic accidents?

Road traffic accidents can be caused by anything, however, the most common causes of road traffic accidents include:

  • Drink driving
  • Drug driving
  • Speeding
  • Careless and dangerous driving driving
  • Failing to pay attention to the road

It is the driver’s duty of care to ensure the safety of all road users; this includes the passengers. If you were involved in an accident as a passenger, you are eligible to claim compensation, even if the driver of the vehicle caused the road traffic accident. If you would like to start a successful claim for the damages that you have faced, contact one of our experienced solicitors at Solicitors On Your Side Scotland now, and get the compensation you deserve.
