About Car Accident Claims

If you’ve been involved in a car accident that was not your fault, you may be eligible to claim compensation. You do not need to have been driving the car to claim. At On Your Side, we understand that even minor car accidents can leave you with long-term injuries and the full extent of the physical and mental toll that car accidents can have.

At Solicitors On Your Side, our solicitors based in Scotland are here to support you through every step of the claims process, and to get you the compensation you deserve.

What is my Car Accident Claim worth?

For a car accident claim, there is no fixed compensation amount for car accident claims. The amount of compensation that you will be due is based on several factors, these include the injuries suffered, vehicle damage, and the impact the accident had on your day-to-day life.

Compensation amounts widely vary from around £2,000 for soft-tissue whiplash injuries up to 5 figure amounts for claimants with more severe injuries.

At Solicitors On Your Side Scotland, we have a team of personal injury experts who will guide you throughout making your claim.

Who can claim a Scottish Car Accident Claim?

Whether you’re a driver, passenger, pedestrian, or any other road user, you’re able to claim for a non-fault car accident.

If you’re unsure whether you can make a claim, get in touch with us today and one of our friendly Scottish solicitors will be happy to help.

How do I know if I can claim?

If you were involved in a car accident through no fault of your own, then it’s likely that you will be able to claim. However, for us to proceed then the following 3 criteria should be met:

  1. You must have sustained an injury as a result of the road traffic accident
  2. The collision must have been a non-fault accident
  3. The accident has to have taken place in the last 3 years (although minors can claim from 3 years after their 18th birthday)

Car Accident Claims FAQ's

  • How long will my car accident claim take?

The length of time a road traffic accident takes to settle can range from a few months to settle a claim for minor injuries, up to several years for more complex or serious injuries.

At On Your Side, we always aim to settle your case for the maximum possible compensation as quickly as possible, however, the length of your case can become longer if the other side attempts to deny or fight the claim.

  • Will I need to go to court?

It’s very unlikely that you will need to go to court for a car accident claim in Scotland.

If your case does go all the way to court, On Your Side will do all they can to ensure that you do not need to attend court yourself, our solicitors will endeavour to represent you outside of court.

As a last resort, if your claim is disputed, you may have to attend court. You will be required to provide evidence of your injuries, any financial losses, and your own account of the accident.

  • Will I need to have a medical examination?

As part of your claim, you will be required to have a medical assessment so that your injuries can be fully assessed by a medical professional.

This medical exam will help us to claim the maximum compensation for you. Doctors will need to examine you to determine how the car accident affected your overall health, or impacted any existing conditions. If you do not claim until after you have healed, you will still need a medical report.

  • What evidence will I need?

If you’ve been involved in a car accident in Scotland, in order to claim, it’s good to gather the following evidence:

    • Photographs/CCTV footage of the vehicle, accident, and physical injuries
    • Written police and medical reports of the accident.
    • Any/All Witness statements
    • Receipts for any expenses incurred due to the accident e.g. public transport costs to treatment
    • A sketch of the accident type (provided by your vehicle insurer)
    • Insurance details for you and all other drivers involved
    • A diary of events following the accident.
